When Post-Accident Drug and Alcohol Testing are Required?

Post-accident drug and alcohol testing are required by FMCSA.

Post-accident drug and alcohol testing are required (Part 382.303 FMCSA):

  • In any accident involving a fatality
  • In any accident involving injury or tow away when the truck driver is cited for a moving violation.

The alcohol test must be done as soon as possible after the accident and if over 2 hours, documentation must be done verifying the reason for the delay.

If 8 hours have passed since the accident, then no alcohol test should be done.

The controlled substance test must be done within 32 hours of the accident. Alcohol and controlled substance testing may also be required under various State Drug-Free Workplace Programs even when FMCSA does not need it.
