DOT regulations for Personal Conveyance use and Company Policies and Procedures

Logiflex is strongly committed to full compliance with the current federal Hours of Service (HOS)
regulations, as well as any additional regulations which may apply. Logiflex main priority is the safety of its
employees and the public. Therefore, the Company has established Personal Conveyance Policies and
Procedures as a major element of individual compliance with the HOS regulations.
Personal Conveyance is the movement of a commercial motor vehicle (CMV) for personal use while offduty. A driver may record time operating a CMV for personal conveyance as off duty only when the driver
is relieved from work and all responsibility for performing work by the Company. The CMV may be used for
personal conveyance even if it is laden, only since the load is not being transported for the commercial
benefit of the motor carrier at the time. Since the Personal Conveyance does not reduce a driver’s or
motor carrier’s responsibility to operate a CMV safely, Logiflex has established certain personal
conveyance limitations. All drivers employed by Logiflex or contracted by Logiflex have a limitation of 60 min per day for Personal Conveyance. The limitation set here does mean that drivers can do Personal
Conveyance only if all requirements for Personal Conveyance time of the DOT have been met.
Every day and frequent use of Personal Conveyance for the maximum allowed time without
reasonable explanation and without being approved by Supervisor will be considered violation of
the Company Policies and Procedures.


Additionally, after each use of PC time an e-mail must be sent to
jefimija@logiflex.com stating:
1. Driver name, truck and trailer number
2. Exact date, time and location before starting the PC use.
3. Intended destination – exact location.
4. Distance travelled, arrival time, and exact location where the PC use has ended.
Failure to send an e-mail and noncompliance with the Policies will result in
Suspension of the PC privileges.
Remark on the ELD device must be made for every Personal Conveyance move stating the
reason for it. Remarks as "out of the truck","PC","P Conveyance","end ofthe day" are not
acceptable. The remarks should state the reasonable explanation for the Personal
Conveyance use-e.g. going to hotel/motel, safe heaven, home, per safety official's request
etc.
Appropriate Uses of a CMV while Off-duty for Personal Conveyance:
1. Time spent traveling from a driver’s en route lodging (such as a motel or a truck stop) to restaurants
or entertainment facilities.
2.Commuting between the driver’s terminal and his or her residence, between trailer-drop lots and the
driver’s residence, and between work sites and his or her residence. In these scenarios, the commuting
distance combined with the release from work and start to work times must allow the driver enough
time to obtain the required restorative rest as to ensure the diver is not fatigued.
3. Time spent traveling to a nearby, reasonable, safe location to obtain the required rest after loading or
unloading. The time driving under personal conveyance must allow the driver adequate time to obtain
the required rest in accordance with minimum off-duty periods under 49 CFR 395.3(a)(1) before
returning to on-duty driving, and the resting location must be the first such location reasonably
available.
4. Moving a CMV at the request of a safety official during the driver’s off duty time.
Inappropriate Uses of a CMV while Off-duty for Personal Conveyance:
1. The movement of a CMV in order to enhance the operational readiness of a motor carrier. For
example, bypassing available resting locations in order to get closer to the next loading or unloading
point or other scheduled motor carrier destination.
2. Continuation of a CMV trip in interstate commerce in order to fulfill a business purpose, including
bobtailing or operating with an empty trailer in order to retrieve another load or repositioning a CMV
(tractor or trailer) at the direction of the motor carrier.
3. Time spent transporting a CMV to a facility to have vehicle maintenance performed.
4. After being placed out of service for exceeding the maximum periods permitted under part 395, time
spent driving to a location to obtain required rest, unless so directed by an enforcement officer at the
scene.
5. Time spent traveling to a motor carrier’s terminal or the driver's home after loading or unloading.
